Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the MarkoutPro application and website (the "Service"). By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the company you represent.

2. The Service

MarkoutPro is a construction project management platform covering, among other things, time logging, payroll support, job costing, bidding, billing, scheduling and field operations. Features may change as the Service evolves; we will not materially reduce the core functionality of a paid plan during a paid term.

3. Accounts & users

• You must provide accurate account information and keep credentials confidential.
• Each plan includes a maximum number of users; all features are included in every plan.
• You are responsible for the actions of users you invite to your account.

4. Subscriptions & billing

• Plans are billed monthly through our payment processor (Stripe). Prices are listed on the pricing page.
• New accounts start with a 14-day free trial; no charge before the trial ends.
• You may upgrade, downgrade or cancel at any time; cancellation stops future charges.

5. Your data

You own the data you enter into the Service (projects, timesheets, financial records, documents, photos). We process it only to provide the Service, as described in the Privacy Policy. You can request an export or deletion of your account data at any time at info@markoutpro.com.

6. Acceptable use

Do not misuse the Service: no unlawful content, no attempts to breach security or access other tenants' data, no reselling of the Service without our written consent.

7. Disclaimers

The Service is provided "as is". MarkoutPro supports — but does not replace — your own professional judgment: figures such as payroll, certified payroll, job costs and bids must be verified by you before use. We are not liable for indirect or consequential damages; our total liability is limited to the fees you paid in the 12 months before the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that materially breach these Terms. After termination we retain account data for a limited period to allow export, then delete it.

9. Changes

We may update these Terms; material changes will be announced in the app or by email before they take effect. Continued use after the effective date means acceptance.
